
Jason P. Herman Obtains $1.9 Million Judgment in Breach of
Contract Dispute

ALTAMONTE SPRINGS, Florida -- TRAUB EGLIN
LIEBERMAN STRAUS LLP (TELS) is pleased to announce that Jason
P. Herman, a partner in the firm's Altamonte Springs office,
obtained a successful judgment for his client, along with
a substantial award on counterclaim at trial.
Mr. Herman successfully represented an IT
and telecom services company in a breach of contract lawsuit
in August, 2005. His client is in the business of providing
customer relationship management and IT consulting services
for a broad range of mid-size and Fortune 1000 companies.
In fact, Mr. Herman's client is ranked as the 12th largest
U.S. inbound teleservices company, with offices in Texas,
Virginia and México.
Mr. Herman's client had agreed to provide
IT and telecommunications support to the Plaintiff, who was
a major supplier in the food service industry. The Defendant
provided computer hardware, software, training and a fully-staffed
call center to the Plaintiff. However, six months into the
agreement, the Defendant notified the Plaintiff that it may
cancel the contract due to non-payment. In response, the Plaintiff
filed suit in Florida for breach of contract, claiming Defendant's
poor performance caused the Plaintiff to lose its largest
clients. Mr. Herman, on behalf of the Defendant, then filed
a counter-claim for breach based on non-payment, and acceleration
of infrastructure costs the Defendant had incurred in servicing
the account.
During pre-trial proceedings, the Plaintiff's
claims were dismissed by the Court. After proceeding through
a bench trial on the Defendant's counter-claim, the Court
awarded the Defendant more than $1.9 million in damages arising
from services rendered, as well as proprietary equipment that
was never returned.
