
Attorney Robert Nobel Succeeds in Winning Dismissal of New York Case against Insurer Seeking Coverage as Additional Insured under Insurance Policy

HAWTHORNE, NEW YORK - TRAUB LIEBERMAN STRAUS & SHREWSBERRY LLP congratulates partner Robert Nobel on their victory in the case West 64th Street, LLC, et al v. AXIS U.S. Insurance, et al, venued in New York Supreme Court, New York County.
Partner Robert Nobel filed a motion to dismiss the action asserted against the insurance carrier. Mr. Nobel obtained a swift and decisive pre-answer dismissal of a coverage action in which plaintiff, the owner of a building under construction, claimed that it was entitled to coverage as an additional insured in an underlying construction accident claim under a general liability policy issued by AXIS. In support of the motion, Mr. Nobel argued that the underlying contract was insufficient to trigger additional insured coverage under the AXIS policy. The court rejected plaintiffs’ argument that the indemnity provision in the contract was sufficient to confer additional insured coverage and dismissed the suit.
