Traub Lieberman Partners Present on New Jersey Insurance Fair Conduct Act and Uninsured Motorist and Underinsured Motorist Coverage

In a recent presentation to an internationally recognized insurer, Traub Lieberman Partners Gregory Pennington and Craig Rokuson provided an overview of the New Jersey Insurance Fair Conduct Act (NJIFCA), along with a review of Uninsured Motorist and Underinsured Motorist coverage. The NJIFCA, which establishes a private cause of action for first-party claimants regarding certain unfair or unreasonable practices by their insurer, was signed into law by Governor Phil Murphy on January 18, 2022. The bill establishes a private cause of action for first-party claimants regarding unfair or unreasonable practices by their insurer in the event of a motor vehicle accident injury entitling the claimant to uninsured or underinsured motorist coverage.

In their program, Gregory and Craig provide an overview of the new legislation and discuss potential interpretation of the term “unreasonable”. They also discuss the application of the law and who it might impact, including uninsured motorist claimants and insurance companies.
