Traub Lieberman Partner Rina Clemens and Associate Shannon Nelsen obtained summary judgment in favor of Defendants in a case brought before the 15th Judicial Court, Palm Beach County, Florida. The Plaintiff, the parent and guardian of a Jiu-Jitsu student, alleged negligence against the Defendants, a martial arts school and its supervisor, following an incident where the Plaintiff student was injured during a Jiu-Jitsu class. The Plaintiff parent alleged both negligent supervision and negligent training of the students, resulting in the incident. In review of the facts of the case, the court found that neither the school nor the supervisor breached their duties to the Plaintiff student and further found that the assumption of risk doctrine applies. As a result, the motion for summary judgment was granted in favor of the Defendants.
