Traub Lieberman attorneys Lisa Rolle and John Aubel won summary judgement in favor of a Religious Institution in a Child Victim’s Act claim brought in the Supreme Court of the State of New York, New York County. In this matter, the Plaintiff was a parishioner at the Defendant religious institution and attended the affiliated school. The Plaintiff allegedly suffered abuse at the hands of a religious leader affiliated with a different religious institution and school. At no time during this period was the Defendant found to be overseeing the care of the Plaintiff in connection with instances of alleged abuse. Therefore, the Court agreed that there was no duty owed to the Plaintiff by the Defendant and the motion for summary judgment to dismiss the complaint was granted.
