
Attorneys Robert Nobel and Denis Farrell Succeed in New York Case Alleging Claimed Respiratory Injuries

HAWTHORNE, New York -- TRAUB LIEBERMAN STRAUS & SHREWSBERRY congratulates Robert Nobel and Denis Farrell on their victory in the case McGrath, et al. v. Transitional Services of New York for Long Island, et al. venued in New York State Supreme Court, Nassau County.
Plaintiffs, two former IRS workers, claimed debilitating respiratory injuries as a result of renovations performed at the IRS building where they worked. The construction work allegedly caused fiberglass, mice feces, hair and construction dust to be released into the work environment. Their suit was filed against the general contractor and various sub-contractors that performed the work. Along with their co-defendants, attorneys Rob Nobel and Denis Farrell filed a motion for summary judgment on behalf of an electrical subcontractor. In their moving papers, counsel argued that, among other things, that plaintiffs could not establish a causal connection between the alleged toxins (construction dust, etc.) and plaintiffs' injuries. The court agreed and dismissed plaintiffs' action.
