Stephen Straus’ practice includes the defense of products
liability actions on behalf of domestic and foreign manufacturers.
This involves litigation and trial of catastrophic injury
and death cases in state and federal courts, as well as appellate
representation concerning myriad evidentiary and dispositive
issues that arise in such matters. Mr. Straus regular provides
manufacturers and insurers with loss prevention and risk management
advice and services.
Mr. Straus represents insurers on a national
scale in all manner of coverage disputes, including claims
involving environmental cleanup, mass toxic torts and professional
liability. This entails providing opinion letters concerning
complex insurance coverage issues, to appearing as counsel
of record in coverage disputes through the litigation, trial
and appellate processes. Mr. Straus also regularly appears
as counsel in the arbitration of disputes between insurers
and reinsurers.
The defense of errors and omissions cases
involving various professional disciplines, including attorneys,
accountants, brokers and agents, also comprises a significant
aspect of Mr. Straus' practice, as does the representation
of religious institutions in liability matters.
Mr. Straus has co-authored articles entitled,
Environmental Coverage Litigation: Special Concerns Facing
Reinsurers, ENVIRONMENTAL CLAIMS JOURNAL and Classifying RI/FS
Costs Under a Policy of Comprehensive General Liability Insurance:
Indemnity or Defense?, FORDHAM ENVIRONMENTAL LAW JOURNAL,
cited with distinction in General Accident Ins. Co. of
America v. State of New Jersey Dept. of Environmental Protection,
143 N.J. 462, 672 A.2d 1154 (1996). His reported decisions
are numerous.
Mr. Straus received his Juris Doctor from
St. John’s University School of Law in 1986. He graduated
from Boston University with a Bachelor of Science in Business
Administration in 1982. Mr. Straus was admitted to the New
York State Bar in 1987. He is also admitted to practice before
the United States Court of Appeals for the Sixth and Seventh
Circuits, as well as the United States District Court for
the Southern and Eastern Districts of New York and the Eastern
District of Wisconsin. He is a member of the American Bar
Association and the Association of the Bar of the City of
New York. |
