New York partner, Colleen E. Hastie, and senior counsel, Brian M. Healy, recently obtained summary judgment dismissing in a premise liability action venued in Westchester County Supreme Court. Plaintiff initially alleged he tripped and fell in a depression on the sidewalk adjacent to a wireless and mobile phone store operated by our client. Following plaintiff’s deposition, we successfully moved for summary judgment arguing that our client has no responsibility for the maintenance and/or repair of the locus of the incident as the alleged fall occurred in the roadway, several store fronts away from our client’s business.
